This article explores the issue of girls’ concerns about sexual activity in a liberal Nordic context. Drawing on ethnographic fieldwork among young people in Denmark, the article identifies three types of concerns girls can have about sexual activity: social expectations, relational expectations and dignity. Whilst contemporary research has tended to focus on the influence different sexual morality discourses have in shaping different expectations and concerns about these, little attention seems to be paid to girls’ normative concerns about sex related to (...) well-being. This article sheds light on how these normative concerns are related to girls’ sense of dignity based on Andrew Sayer’s work on dignity and moral sentiments. Finally, the article argues that tension between sexual morality discourses and moral sentiments may be the source of resistance that girls practise with a new ‘fuckboy’ discourse. (shrink)

BackgroundEthically challenging critical events and decisions are common in nursing homes. This paper presents nursing home doctors’ descriptions of how they include the patient and next of kin in end-of-life decisions.MethodsWe performed ten focus groups with 30 nursing home doctors. Advance care planning; aspects of decisions on life-prolonging treatment, and conflict with next of kin were subject to in-depth analysis and condensation.ResultsThe doctors described large variations in attitudes and practices in all aspects of end-of-life decisions. In conflict situations, many doctors (...) were more concerned about the opinion of next of kin than ensuring the patient’s best interest.ConclusionsMany end-of-life decisions appear arbitrary or influenced by factors independent of the individual patient’s values and interests and are not based on systematic ethical reflections. To protect patient autonomy in nursing homes, stronger emphasis on legal and ethical knowledge among nursing home doctors is needed. (shrink)

This article takes its point of departure in a research project studying the psychosocial problems of living with HIV. The project was intended to participate in changing practices dealing with these problems. It became a project including many differently situated and intersecting personal and generalized perspectives. The article researches the development of the HIV project as a contribution to discussions related to Participatory Action Research and Practice Research. In mainstream approaches methodological indications are often presented as rules to follow in (...) order to ensure the quality of the obtained knowledge. But situated historical and societal processes are involved in the effectuation of the HIV project, like they are in any other project. Researching the project heightens the awareness of the necessity of reflecting on situated and historical issues of power and marginalization and on the positions of the researcher in a given field of research. Methodological flexibility may also be necessary in order to encompass different perspectives. Such reflections and strategies are necessary precisely to ensure the development of knowledge and practice alike. (shrink)

When not acting in ways that are recognised as physical self-defence, women are often – in psychology and in other dominant discourses – generalised as inherently passive during subjection to sexualised coercion (rape and attempted rape). Likewise, in the aftermaths, their (in)actions are frequently pathologised as ‘maladaptive coping strategies’. We present theoretically and empirically based arguments for an agency-oriented approach to women’s perspectives on sexualised coercion. Agency is understood as intentional, situated and strategic. Sexualised coercion is not generalised as a (...) single “traumatic” event, but conceptualised as life events. Meanings of coercion are embedded in social activities connected to discourses on ‘rape’ and ‘trauma’. Thus personal meanings of subjection are understood as developed in and through participation in trajectories across diverse contexts. Adopted in our study, this approach points to the great diversity of personal meanings of sexualised coercion. Moreover, it reveals intimate connections between situated, personal and dominant discursive meanings of coercion, and women’s strategies of (in)actions during and in the aftermaths of the events. Our analysis of participants’ perspectives also indicates an imperative need for reinterpreting concepts such as ‘victim’ and ‘passivity’. In a reinterpretation women, although subjected to sexualised coercion, emerge as subjects both during subjection and in the aftermaths. Furthermore their seemingly pathological behaviour may be re-conceptualised as person ally sense-making strategies of action in reflected attempts at (re)formulating and (re)organising their life strategies. Our world is under going an enormous digital transformation. Nearly no area of our social, informational, political, economic, cultural, and biological spheres are left unchanged. What can philosophy contribute as we try to under- stand and think through these changes? How does digitization challenge past ideas of who we are and where we are headed? Where does it leave our ethical aspirations and cherished ideals of democracy, equality, privacy, trust, freedom, and social embeddedness? Who gets to decide, control, and harness (...) the powers of digitization and for which purposes? Epistemologically, do most of us understand these new mediations – and thus fabrics – of our new world? Many of the elderly in nursing homes are very ill and have a reduced quality of life. Life expectancy is often hard to predict. Decisions about life-prolonging treatment should be based on a professional assessment of the patient’s best interest, assessment of capacity to consent, and on the patient’s own wishes. The purpose of this study was to investigate and compare how these types of decisions were made in nursing homes and in hospital wards. Using a questionnaire, we studied the (...) decision-making process for 299 nursing home patients who were treated for dehydration using intravenous fluids, or for bacterial infections using intravenous antibiotics. We compared the 215 patients treated in nursing homes to the 84 nursing home patients treated in the hospital. The patients’ capacity to consent was considered prior to treatment in 197 of the patients treated in nursing homes and 56 of the patients treated in hospitals. The answers indicate that capacity to consent can be difficult to assess. Patients that were considered capable to consent, were more often involved in the decision-making in nursing homes than in hospital. Next of kin and other health personnel were also more rarely involved when the nursing home patient was treated in hospital. Whether advance care planning had been carried out, was more often unknown in the hospital. Hospital doctors expressed more doubt about the decision to admit the patient to the hospital than about the treatment itself. This study indicates a potential for improvement in decision-making processes in general, and in particular when nursing home patients are treated in a hospital ward. The findings corroborate that nursing home patients should be treated locally if adequate health care and treatment is available. The communication between the different levels of health care when hospitalization is necessary, must be better. The aim of the study was to compare the acute effects of traditional resistance training and superset training on training duration, training volume and different perceptive measures. Twenty-nine resistance-trained participants performed a whole-body workout traditionally and as supersets of exercises targeting different muscle groups, in a randomized-crossover design. Each session was separated by 4–7 days, and consisted of eight exercises and three sets to failure. Training duration and number of repetitions lifted were recorded during the sessions. Rate of perceived exertion (...) for effort, rate of perceived exertion for discomfort, session displeasure/pleasure, and exercise enjoyment were measured 15 min after each session. Forty-eight hours after the final session participants reported which session they preferred. The superset session led to significantly higher values for RPE and RPD and tended to be higher for sPDF, i.e., more pleasurable, compared to the traditional session. There was no difference in EES. The traditional session led to significantly increased training volume and lasted 23 min longer than the superset session. Eighteen of the participants preferred the superset session, while 11 preferred the traditional session. In conclusion, performing a whole-body workout as a superset session was more time-efficient, but reduced the training volume and was perceived with greater exertion for effort and discomfort than a traditional workout. The norm of assertion, to be in force, is a social norm. What is the content of our social norm of assertion? Various linguistic arguments purport to show that to assert is to represent oneself as knowing. But to represent oneself as knowing does not entail that assertion is governed by a knowledge norm. At best these linguistic arguments provide indirect support for a knowledge norm. Furthermore, there are alternative, non-normative explanations for the linguistic data (as in recent work from (...) Van Elswyk). Direct arguments would rely on normative judgments about the permissibility or impermissibility of assertions with and without the speaker knowing the content asserted. John Turri's work experimental results purport to show that our norm of assertion is factive, and probably knowledge. But as a number of recent experimentalists (Kneer, Reuter and Broessel, Marsili and Wiegmann) have shown, Turri's results rely on the problemmatic use of 'should' as in 'Maria should assert that she owns a 1990 watch.' Correcting for this, these experimentalists provide strong evidence that our norm of assertion is not factive. The standard reply to evidence like this from the assertion of unlucky falsehoods is the excuse maneuver. But Marsili and Wiegmann, following Turri's protocol for testing for excuse validation, show that participants who judge that assertions unlucky falsehoods are permissible are not guilty of excuse validation. Given our current understanding of the experimental evidence, knowledge is not our norm of assertion. (shrink)

This book provides a clear introduction to the subject for both mathematicians and the non-specialists now needing to learn some model theory.

IN THE LAST PART of the Theory of Moral Sentiments, Adam Smith puts his theory in a class with those of his contemporaries Francis Hutcheson and David Hume, namely, the systems that make sentiments the principle of approbation. Despite recognizing important differences with both of them, he thinks that since he has placed the origin of moral sentiments in sympathy, and in particular the fact that we are able to enter into the motives of the agent and get pleasure from (...) finding them appropriate to their cause, sentiments are the foundation of his theory of morals. Many of Smith’s commentators, in fact almost all of the most important studies over the last few years, reaffirm the author’s self-description. However, my aim in this paper is to challenge this view by showing that Smith’s system can also be plausibly seen as a theory of practical reasoning, and in some important aspects very similar to Aristotelian ethics. Surprisingly few scholars have seen this parallel. Laurence Berns, Samuel Fleischacker, Charles Griswold, and Gloria Vivenza are the latest exceptions, identifying several points of coincidence between Adam Smith and Aristotle’s ethics. None of them, however, has tied all these similarities under a unified interpretation, such as the one I propose here: The basic analogy between these theories, and the source of those particular coincidences, is the operation of practical reason. Moreover, and besides the common elements with Aristotle’s ethics, Smith’s reconstruction of practical reason simultaneously announces some of the main features of modern accounts of ethics, such as impartiality and universality as preconditions of moral judgment. The integration of these ancient and modern elements in a single coherent theory allows Smith’s TMS to overcome the insufficiencies and paradoxes of both these traditions, and it constitutes one of the most interesting and challenging proposals of modern ethics. En este libro, la autora desarrolla su concepción del juicio reflexionante inspirada en Emmanuel Kant y en Hannah Arendt para concentrarse en cómo cierto tipo de narraciones modelan nuestras nociones de lo que consideramos moral. Lara nos ofrece distintas concepciones sobre el mal en su formulación histórica mediante los ejemplos de las tragedias griegas, las diferentes concepciones sobre el mal en la obra de Shakespeare, el uso literario de la metáfora en la obra de Joseph Conrad y en narraciones fílmicas (...) que describen la crueldad humana. Lara sugiere que el aprendizaje moral es un proceso en el que intervienen las instituciones sociales, la voluntad de los individuos y de las sociedades para comprometerse a un debate abierto y con ello modelar los juicios colectivos sobre el pasado. Lara enfatiza que el juicio reflexionante se da entre un evento, una narración de dicho evento y la recepción pública de dicha narrativa. En este libro se aportan importantes métodos para la comprensión del fenómeno moral del mal, porque introducen nuevas verdades desvelatorias acerca de eventos particulares que no pueden ser simplemente captados por medio de categorías conceptuales. Lara utiliza como fuentes a Jürgen Habermas, Walter Benjamin, Primo Levi, Giorgio Agamben y Ariel Dorfman para probar la conclusión de este tipo de narraciones: la acción (de crueldad) ata de manera definitiva al perpetrador con su víctima. Gegenstand der Arbeit ist der bedeutende Begriff der Anerkennung in drei Texten Hegels, dem System der Sittlichkeit (1802-3), der Jenaer Realphilosophie (1805-6) und der Phänomenologie des Geistes (1807). Vor diesem Hintergrund wird dann die kritische Auslegung und Ausarbeitung dieses Begriffes im philosophisch-politischen Denken Axel Honneths dargelegt.

La integración de la tecnología en el ámbito del derecho penal plantea desafíos significativos debido a la falta de regulación de la inteligencia artificial (IA), lo que podría comprometer los derechos fundamentales. Este estudio se centra en abordar estos desafíos y proponer soluciones mediante un análisis exhaustivo de la situación actual y las posibles implicaciones de la IA en el sistema jurídico penal. El objetivo principal de esta investigación es analizar los problemas, desafíos y oportunidades que surgen con la implementación (...) de la inteligencia artificial en el ámbito penal. Se busca identificar la necesidad de una regulación específica para la IA en el derecho penal, con el fin de proteger los derechos fundamentales de las personas y garantizar un sistema jurídico justo y equitativo. Para abordar esta problemática, se adoptó un enfoque metodológico cualitativo. Se llevó a cabo una revisión bibliográfica detallada para examinar los antecedentes, problemas y desafíos asociados con la IA en los sistemas jurídicos, especialmente en el ámbito penal. Además, se realizaron análisis de criterios y opiniones de expertos en derecho para obtener una comprensión más profunda de la situación y las posibles soluciones. Los resultados de este estudio revelan la necesidad urgente de establecer una normativa específica para regular la aplicación de la inteligencia artificial en el ámbito penal. Se destaca que la falta de regulación representa un riesgo significativo para los derechos fundamentales, especialmente en lo que respecta a la configuración de delitos con el apoyo de la IA. Además, se identifican diferentes dimensiones que deben abordarse en la regulación, incluyendo principios y reglas básicas del derecho, supervisión humana de los sistemas de IA y la promoción de la innovación responsable en este campo. Este artículo subraya la importancia de establecer una regulación efectiva para la inteligencia artificial en el ámbito penal. Esta regulación no solo protegerá los derechos fundamentales de las personas, sino que también promoverá un uso responsable y progresivo de la IA como una herramienta valiosa para los profesionales del derecho. Es crucial que la regulación sea integral y adaptable para garantizar un sistema jurídico justo y equitativo en la era digital. (shrink)

The correspondence of (...) the argentine philosopher Francisco Romero (Seville, 1891 - Buenos Aires, 1962) with colleagues and disciples of Chile and foreign voluntarily or not settled in that country, constituted a remarkable intellectual network in the knowledge of America, between 1934 and 1962. The construction of Philosophical Americanism was a central concern, and reflections that occurred were connected with political, ideological, social, cultural and economic circumstances of each member. La complejidad de los fenómenos sociales que presenciamos en la actualidad resulta inabarcable exclusivamente desde la categoría de pobreza y sin embargo, el diseño e implementación de políticas sociales se continúa abordando desde un paradigma o esquema pensado en clave desde la noción de pobreza. Teniendo en cuenta estas ideas en el presente artículo, se propone analizar la categoría de “pobreza”, intentando discutir en torno a las siguientes cuestiones: ¿cuál es el lugar que debería ocupar la noción de pobreza en (...) el diseño de un diagnóstico de la situación social actual? ¿En qué medida la pobreza es una noción adecuada como ordenadora del diseño de políticas sociales? ¿Qué implicancias tiene pasar de una mirada centrada en el problema de la pobreza hacia otra atenta a la diversidad de configuraciones sociales en que transcurre la vida cotidiana? ¿Cuál es el lugar que le corresponde a la idea de pobreza en la matriz a partir de la cuál pensar actualmente la política social y las respuestas que éstas brindan desde el Estado? É fundamental — continua a sê-lo — repensar e questionar campos temáticos à luz das análises teóricas e concetuais, (...) mas também dos processos, das dinâmicas, das relações, das potencialidades explicativas da nossa contemporaneidade. É assim que se entende este livro, com muitas contribuições, que vêm propiciar e enriquecer a reflexão sobre Outros Combates pela História. Combates pela História é, como se sabe, o título de um livro famoso de Lucien Febvre dos anos cinquenta. Através de uma recomposição, de novo se deu importância a todas as modalidades da História, mantendo, todavia, o sentido do rigor que era algo perseguido nos «combates pela História». Quer-se, pois, analisar o sentido da História, nas suas várias áreas. Contudo, ao propor-se este tema, não se desejou que os autores apresentassem tanto as suas investigações nas suas áreas próprias — embora elas estivessem subentendidas e devessem ser expressas —, mas que refletissem sobre o seu sentido no âmbito da História entendida como Ciência Social e Humana. Para tal, desejou-se que discutissem o objeto e o método da História das diversas áreas, equacionando os seus vários problemas. Foi isso que também sucedeu — estamos disso convencidos. Mas será o leitor, melhor do que ninguém, a ajuizá-lo. (shrink)

Este artículo debate algunas de las cuestiones que el Profesor Puntel discute en su conferencia “‘verdad’ como concepto ontológico-semántico” (2007). La conferencia de Puntel toca numerosos aspectos de la noción de verdad; de entre ellos, hemos aislado dos conjuntos temáticos. El primero tiene que ver con cuestiones preliminares acerca de la verdad que el Prof. Puntel discute antes de presentar su posición. El segundo está relacionado con la posición particular que Puntel defiende y en concreto con su crítica a las (...) teorías pro-oracionales. El primer asunto tiene relevancia porque las cuestiones preliminares en teoría de la verdad constriñen el desarrollo posterior de la teoría de manera determinante; el segundo aspecto tiene relevancia porque la crítica de Puntel encierra ciertos malentendidos de fondo que desdibujan su propia posición y le impiden tener el alcance que el Prof. Puntel le atribuye. El presente trabajo pretende dar respuesta a la demanda, abiertamente hecha por Kuhn y Feyerabend , así como por los impulsores de la corriente estructuralista, Balzer, Moulines & Sneed , sobre la necesidad de analizar estructuralmente casos históricos de teorías inconmensurables para llegar a precisar formalmente y dar soporte empírico a la noción de inconmensurabilidad. El trabajo se estructura en tres partes: en la primera, se aclara el tipo de entidad teórica que conformarían las teorías del flogisto y del oxígeno; (...) en la segunda, se presentan sus correspondientes reconstrucciones estructurales y finalmente, en la tercera, se desarrolla un análisis de las relaciones interteóricas entre la teoría del flogisto y la del oxígeno, mostrando cómo su modo de relacionarse satisface las condiciones establecidas en las definiciones de reducción ontológica débil y de inconmensurabilidad. Leibniz's repeated interventions in the Trinitarian polemics widespread throughout Europe in the seventeenth and eighteenth centuries cannot merely be read as scholastic exercises or concessions to the conventions of his time. On the contrary, they involved reflection on issues fundamental to Leibniz's philosophical doctrines: issues such as the relationship between faith and reason, the limitations of the human intellect and the various grades of human knowledge, and the significance of the ' analogia Trinitatis' reconsidered in light of the concept of (...) harmony. This paper concentrates on the writings of the young Leibniz before his visit to Paris and aims to examine the role played by contemporary discussions concerning the Trinity and the Incarnation in the formation of Leibniz's thought.
